Terms
Plain terms for using this site.
The pages describe what we build. A price is a price, a demo is a demo, and any work we do together runs on a written scope, not on a web page.
Section 01Who these terms are between
This website is operated by Artery Systems LLC, a Virginia limited liability company. By using the site you agree to these terms, and the chat links to them where you use it. If you do not agree, the remedy is simple: do not use the site.
These terms cover the website. Work we do for a client is governed by the written scope and agreement for that work, which takes precedence over anything here.
Section 02What the site is
The pages describe the systems we build and how we work. They are information, not a contract. Chatting or booking a call does not make you a client and does not commit either of us to anything. No agreement for services exists until you have a written scope from us and have agreed to it.
The prices on the pricing page and the service pages are our current prices, in US dollars. Where a price says “from”, it is a starting price; where a service is marked as quoted, its price depends on scope. Prices may change before a written scope is agreed. Once it is, the number you pay is the number in it.
Section 03Payment, refunds and cancelling
These are the payment terms in every written scope we send. The prices themselves are on the pricing page and in your scope.
- Build
- 50% upfront, which books your start date, and 50% at launch. This covers a website and the one-time setup of any other service.
- Monthly billing
- Monthly plans (the care plan, the receptionist, the web concierge, getting found on Google and ads management) are billed monthly by card.
- Phone number and text messages
- we run them for you on our Twilio account and pay Twilio. We pass the cost through at cost, with no markup, as a line on your monthly invoice. You do not need a Twilio account. Your other vendors (your domain and hosting, your calendar or Jobber plan, your own business phone line) bill you directly.
- The phone number is yours
- the number transfers to you on request, including when you cancel.
- Refunds
- if design work has not started, we refund the full deposit. After work has started, you pay for the work done so far, and we refund any unused part of the deposit.
- Term and cancelling
- Monthly plans are month to month, with no minimum term. You can cancel with 30 days’ notice.
- Changes
- Changes outside your scope are $75 an hour, billed in 30-minute blocks, and quoted in writing before the work starts.
Section 04The one-week Starter promise
The promise at a glanceA summary; the full terms below apply.
- Deadline
- 7 calendar days, US Eastern time
- The count starts
- The day after your signed scope and all your copy and photos
- If we are late
- $100 off the Starter price
- Covers
- The Starter website only
A Starter website, our one-page tier, is live in under a week once we have your copy and photos, or $100 off. In full:
- “Under a week” means within 7 calendar days, counted in US Eastern time. Day one is the day after we have both your signed scope and all the copy and photos that scope lists.
- “Live” means the finished page, built to your signed scope, is published at your domain, where anyone can open it. A preview link does not count.
- If the page is not live by the end of day 7, $100 comes off the Starter price in your scope. It comes off what you still owe; if you owe less than $100, or nothing, we refund the difference to you.
- The count pauses on any day we are waiting on something we have asked you for, such as your feedback on the preview, a login, access to your domain, or a payment the scope says is due, and resumes the day after we have it. If you ask to change the scope after signing it, the promise no longer applies to that project; your one round of changes on the preview is not a change of scope.
- One $100 credit per project. It does not stack with another discount: where one applies, you get the larger of the two, not both.
The promise covers the Starter website only, not the Editable or Custom websites or any other service. It is part of every Starter scope we send. If a scope ever leaves it out, it applies anyway: this is the one place where these terms add to a written scope.
Section 05The founding-client offer
The offer at a glanceA summary; the full terms below apply.
- Who
- The first 3 businesses that buy a website
- Waived
- The $750 AI Receptionist setup fee
- Still billed
- The $249 monthly, usage, and the website
- Ends
- When the 3 places are taken or the offer comes off the site
The first 3 businesses that buy a website from us while this offer is shown on the site pay no setup fee for the AI Receptionist. In full:
- It applies only with a website purchase: a signed website scope (any website tier). The AI Receptionist scope can be signed with the website’s or at any time after it, and the $750 AI Receptionist setup fee is then waived.
- The setup fee is the only thing waived. The receptionist’s monthly is still $249, on the normal terms: billed monthly by card, no minimum term, and you cancel with 30 days’ notice. Usage past what the monthly includes (call minutes, the phone number, texts) is billed at the normal rates. The website is charged at its normal price.
- One per business. It does not stack with another discount: where one applies, you get the larger of the two, not both.
- The offer ends when the 3 places are taken or when we remove it from the site, whichever comes first. A place is taken when a website scope is signed under it; a business that signed its website scope before then keeps it.
- In return, we ask for your honest feedback once you’ve used it.
Section 06Demos and previews
Every demo call, transcript, and worked example on the site is scripted. The businesses, owners, callers, addresses, and times in them are fictional. They show how a system behaves, not what happened for a real customer.
The “Make it yours” preview on the showcase page is a mock-up drawn in your browser from the name you type. It is an illustration. It is not an offer, not a real website, and not a statement that the business named is our client or has any connection to us. Type only a name you have the right to use.
None of these is a promise of results. What a receptionist, an automation, or a website does for your business depends on your calls, your calendar, your systems, and how the work is set up, which is what the written scope is for.
Section 07The AI chat
The chat on this site is an AI assistant. It gives general information about our services. It can be wrong, out of date, or incomplete, and what it says is not professional advice of any kind.
The chat cannot agree to a price, a scope, or a deadline on our behalf. If something it says differs from the pricing page or from a written scope, the written version applies. A time requested through the chat is a booking only once it is confirmed to you by email.
Section 08Using the quote form, the chat and the scheduler
When you ask for a quote, use the chat or book a call, you agree to:
- give accurate details, including a phone number we can actually reach you on;
- use them to ask about work for your business, not to send bulk or automated messages;
- not submit anything unlawful, abusive, or belonging to someone else;
- not try to get around the limits that keep the quote form and the chat from being abused, or to make the chat act outside its purpose;
- not probe, scrape, overload, or attempt to gain access to restricted parts of the site.
When you send the quote form, you agree we may call or text you at the number you gave about your quote. Message and data rates may apply. Reply STOP to any text to opt out.
We may limit or block use that breaks these rules. The scheduler is provided by Cal.com and runs under Cal.com’s own terms. How we handle what you send us is on the privacy page.
Section 09Ownership of the site
The text, drawings, demos, design, and code of this site belong to Artery Systems LLC unless marked otherwise. You may read the site and share links to it. You may not copy, republish, or reuse its content or code for your own site or product without our written permission.
Artery Systems and the Artery Systems mark are ours. Other names on the site, such as Cal.com, belong to their owners and are named only to describe what the site uses.
Section 10Other sites and services
The site links to, or loads, services run by others, such as the Cal.com calendar and our Google review page. We do not control them, and their own terms and privacy policies apply there.
Section 11Marketing and ads
For getting found on Google, ads, email and text marketing, and social posting, these points are part of every written scope we send:
- Ad spend is separate from our fee. You pay it to the platform (Google or Meta) directly, on your own account, at the platform’s prices. We add no markup.
- You own the accounts: your Google Business Profile, your Google Ads and Meta ad accounts, your social pages and your customer lists. You give us access to work in them, and you can remove it at any time.
- Google, Meta and the phone carriers approve ads, listings, Local Services Ads screening and text registration under their own policies. Those decisions are outside our control.
- We do not guarantee rankings, leads, calls, sales or any other result. Platforms decide who sees what, and that changes.
- You confirm you have the rights to the photos, logos and content you give us to use.
- Email and text campaigns go only to people who agreed to hear from you. Every message carries a way to opt out, and opt-outs are honoured.
Section 12No warranty, limited liability
The site is provided “as is” and “as available”. To the fullest extent the law allows, Artery Systems LLC disclaims all warranties about the site, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We work to keep the site accurate and running, but we do not promise that it is error-free, uninterrupted, or current at every moment.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profits or data, arising from your use of the site, including reliance on a demo, a preview, or a chat reply, and our total liability for all claims about the site is limited to $100.
Nothing here limits liability that the law does not allow us to limit. Paid work is governed by its own written agreement, not by this page.
Section 13Governing law
These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. A dispute about the website that we cannot settle by talking it through belongs exclusively in the state or federal courts located in Virginia, and you and we consent to those courts. If any part of these terms is found unenforceable, the rest still applies.
Section 14Changes and contact
We may update these terms. When we do, the date at the top changes, and the new terms apply to use of the site from then on.
Questions about these terms: contact@arterysystems.com or (443) 494-6667.
